Important Notice
Please read these Terms of Service carefully before using our prenuptial agreement services. By placing an order with UK Prenup, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. UK Prenup is not a law firm and does not provide legal advice; both parties should consider independent legal advice before signing.
UK Prenup is a service provided by Custom Coded Websites Ltd, trading as UK Prenup, offering prenuptial agreement preparation services to couples marrying under the law of England & Wales. These Terms govern your access to our website and the use of our prenuptial agreement services.

Legal Standing of Documents
All documents produced through UK Prenup are prenuptial agreements for couples in England & Wales, completed from your answers using a template written by UK Prenup for the law of England & Wales. UK Prenup is not a law firm and does not provide legal advice. The independent legal advice every package includes is given by a family-law solicitor on the UK Prenup panel, acting for their own client alone: for one of you, or for each of you, depending on your package.
1. Service Overview
UK Prenup provides comprehensive prenuptial agreement preparation services for couples whose marriage will be governed by the law of England & Wales. Our services are designed to prepare documents in accordance with UK laws that set out how each partner wishes to treat their assets and debts before marriage.
What We Provide
Prenuptial Agreements
- Your agreement as a PDF draft for review, prepared once you have paid, and ready to sign once your partner has confirmed it and the advice your package includes has been recorded
- Independent legal advice on your agreement from a family-law solicitor on the UK Prenup panel: for you with the £750 package, or for each of you, at different firms, with the £1,300 package. The firms on our panel are named in our Privacy Policy; each adviser is independent and regulated, and acts only for the partner they advise
- Access to re-download the current version of your agreement from your account for 6 years after your order is completed, as long as you sign in at least once every 3 years, as set out in our Privacy Policy, with a final copy emailed to you before we delete it (see section 5). We do not hold a copy of your signed agreement.
- Guidance on completing your agreement and signing with independent legal advice
Both Partners
- Provision for both parties to disclose their financial position
- Clear sections covering assets, debts, and property
- Space for each partner's signature and an independent witness
- Guidance encouraging full financial transparency between partners
Independent legal advice for each partner is strongly recommended; enforceability cannot be guaranteed.
Two Logins, One Agreement
- You and your partner each have your own login, linked to one shared agreement. There is no joint login, and neither of you can sign in as the other.
- You invite your partner from your account. They set up their own login from that invitation and accept their own short terms of use; they do not become a party to these terms.
- Each of you takes your own steps (confirming the agreement, recording your advice or a decision not to take it, recording your signing) from your own login, and we record each step against the person who took it.
- Your partner's advice, and which solicitor gives it, is private to them and their solicitor, as yours is to you. Once your partner has joined, only they can change their own details and email address.
- Each of you can download your own information and close your own account from Settings. Closing your account never deletes your partner's copy of the agreement or its record.
Delivery
- Digital delivery: your draft PDF is emailed to you and is in your account once you have paid, and each updated version is in your account too
- Nothing is sent by post; you print and sign your agreement yourself
Service Limitations
- We provide prenuptial agreement preparation services only.
- We do not provide legal advice, court representation, or assistance with complex legal matters requiring a solicitor.
- We do not guarantee that a prenuptial agreement will be upheld or enforced by a court.

2. Eligibility Requirements
To use our prenuptial agreement services, you must meet specific eligibility criteria established by UK law and our service standards.
General Requirements
To be eligible, both parties must:
- Be a legal resident of the United Kingdom. Our prenuptial agreement is prepared under the law of England & Wales; couples marrying or resident in Scotland or Northern Ireland should take local legal advice, as different rules apply
- Be 18 years or older and intending to marry
- Enter into the agreement freely and without pressure
- Provide accurate and truthful financial information
- Not be subject to bankruptcy proceedings that prevent the agreement
- Not be using the agreement to defraud creditors or avoid legal obligations
Both Parties' Requirements

Prohibited Uses
We cannot prepare prenuptial agreements that are:
- Intended to defraud or mislead a partner or third party
- Based on incomplete or dishonest financial disclosure
- Entered into under duress or undue pressure
- Intended to deprive children of reasonable provision
- Related to avoiding creditors or legal obligations
Additional Discretion
We reserve the right to refuse service for any agreement deemed inappropriate, unlawful, or contrary to our service standards.
3. Legal Validity
Our prenuptial agreements are prepared from a template written by UK Prenup for the law of England & Wales; UK Prenup is not a law firm. Prenuptial agreements are not automatically binding in England & Wales, but a court may give them significant weight where they have been entered into fairly.
Factors Courts May Consider
While we cannot guarantee that any agreement will be upheld, courts in England & Wales are more likely to give weight to an agreement where:
Fairness Factors
- Full financial disclosure by both parties
- Each partner had independent legal advice
- The agreement was signed without pressure
- It was signed well before the wedding
- Both parties understood its terms
Practical Use
- A clear record of each partner's intentions regarding assets, debts, property, and inheritance before marriage

- Documents are prepared in line with relevant legislation in England & Wales.
- UK Prenup is not a law firm and does not provide legal advice; both parties should consider independent legal advice before signing, and the weight given to an agreement may vary with each couple's circumstances.
4. Payment Terms
We offer transparent, competitive pricing with secure payment processing for all our prenuptial agreement services.

- SSL encryption, PCI DSS compliance, 3D Secure, fraud protection
Payment information is processed securely by third-party providers; we do not store full card details.
Payment Policy
- All payments must be made in full before document preparation begins
- Prices are inclusive of VAT where applicable
- Currency is British Pounds (GBP)
- Payment confirmation triggers the start of document preparation
- Receipts are automatically emailed upon payment
- Failed or declined payments will prevent order processing

5. Document Delivery
Your prenuptial agreement is a digital product. The PDF is emailed to you immediately after purchase, and you can re-download the current version of your agreement from your secure account for 6 years after your order is completed, as long as you sign in at least once every 3 years (the retention periods set out in our Privacy Policy), and for longer while our lawyer sets the final period: until then we do not delete paid agreements automatically. Before we delete it, or close an account that holds it, we will email you a final copy. Before we delete it, we email your partner a final copy too. If you close your account from Settings, your login goes but the agreement and its record stay, for your partner and for the period in our Privacy Policy. Nothing is sent by post: you print and sign the agreement yourselves, following the signing and witnessing guidance included. We do not hold a copy of your signed agreement, so keep your signed original safe.
If you placed your order before 21 October 2026, when these terms promised permanent access to re-download your agreement, we will not delete it without first giving you notice and emailing you a final copy.

Delivery Notes
- Your agreement is delivered by email and by download from your account; nothing is posted.
- We are not liable for delays caused by events outside our reasonable control, such as a system outage.
6. Customer Responsibilities
To ensure a smooth prenuptial agreement process, both partners have the following responsibilities:
Information Accuracy
- Provide complete and accurate personal and financial details for both partners
- Fully and honestly disclose all assets and debts
- Confirm your email addresses are correct
- Report any errors to us immediately
Document Execution
- Both partners must sign documents correctly according to instructions
- Obtain independent witness signatures where required
- Follow all execution guidelines provided
- Each partner is responsible for obtaining their own independent legal advice before signing
- Keep your signed original safe; we do not hold a copy of your signed agreement
Before the Wedding
- Sign the agreement well in advance of the wedding date
- Review and update the agreement together if your circumstances change
We are not responsible for any issues resulting from incomplete disclosure, signing under pressure, or failure to follow instructions.
7. Refund Policy
Your prenuptial agreement is digital content that is generated and made available to download immediately after purchase, and is prepared specifically for you. For this reason we do not offer a general “change of mind” refund once your agreement has been generated. This does not affect your statutory rights under UK consumer law, which are set out below.
Your statutory 14-day right to cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have a 14-day right to cancel a distance purchase. Because your prenuptial agreement is digital content supplied immediately, when you ask us to generate it and make it available to download straight away you expressly consent to that immediate supply and acknowledge that you lose this 14-day right to cancel once the download begins. Your other statutory rights are not affected.
When you are entitled to a refund
Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose and as described. We will provide a refund, repair or replacement where:
Your statutory rights
- The prenuptial agreement provided is incorrect due to an error on our part
- Technical failures prevented delivery of your agreement through no fault of your own
- The document is faulty, not as described, or not fit for purpose
When refunds are not available
Outside your statutory rights above, refunds are not available for:
- A change of mind after your agreement has been generated and made available to download
- Customer errors in personal details, financial information, or contact information
Requesting a Refund

- Each request is reviewed and processed promptly

- Nothing in these terms removes or limits your rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013
8. Limitation of Liability
While we strive to provide excellent service, our liability is necessarily limited by law and practical considerations.
Nothing in these terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be limited or excluded under applicable law (including your statutory rights under the Consumer Rights Act 2015). The limitations below apply only to the extent permitted by law.

- We cannot guarantee that a prenuptial agreement will be upheld or enforced by a court, as outcomes depend on each couple's circumstances and are beyond our control.
- UK Prenup is not a law firm and does not provide legal advice; both parties should consider independent legal advice before signing.
Liability Limitations
Excluded Damages
Indirect or consequential losses, loss of profits or business, data loss or corruption, or a court declining to uphold the agreement.
Maximum Liability
Our total liability for any claim arising from this service is limited to the service fee paid.
These limitations do not affect statutory rights under UK consumer law.
Third-Party Disclaimer
We are not liable for decisions or actions taken by courts, solicitors, or other third parties regarding your prenuptial agreement.
9. Governing Law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the jurisdiction of English courts.
