In England & Wales a prenuptial agreement is not automatically binding on a court. However, following the Supreme Court decision in Radmacher v Granatino (2010), the courts will give effect to a prenup that is freely entered into by both parties, with a full appreciation of its implications, unless it would be unfair to hold the parties to it. In practice this means a well-prepared agreement carries significant persuasive weight.

To give your agreement the best chance of being upheld, couples should make sure:

  • Both partners give full and frank financial disclosure of assets, debts, income, and pensions
  • Each partner has the chance to take independent legal advice before signing
  • The agreement is signed well before the wedding, free from pressure
  • The terms are fair and meet the reasonable needs of both parties and any children
  • Neither partner is rushed, pressured, or signing under duress

The Process

We've designed the process to be as simple as possible. Here's how it works from start to finish:

Both partners set out their assets, debts, and how you'd like things divided. We then generate your agreement instantly and make it available to download from your dashboard.

Review it and take advice

Each partner should read the agreement carefully and consider independent legal advice before signing, ideally well before the wedding.

Sign and store it safely

Both partners sign the agreement, each in front of a witness. Log into your dashboard to store your signed agreement securely and revisit it whenever you need.

Each partner should sign in front of their own independent witness — someone over 18 who knows you personally but isn't related to either party or living at your address. Most people ask a friend, colleague, or neighbour.

Valid Witnesses

  • Any friend or colleague over 18
  • A neighbour who knows you
  • A professional (teacher, manager, etc.)

Cannot Be Witnesses

  • Family members (by blood or marriage)
  • Anyone living at your address
  • Your partner (the other party to the agreement)

Your witness simply watches you sign, then signs the agreement themselves and adds their name and address. That's it — no formal role, no paperwork for them.

A prenup lets both partners set out, in advance, how you'd like your finances to be treated if the marriage were ever to end. Couples commonly use one to address:

  • Property and savings — including assets each partner brings into the marriage and how they should be treated
  • Debts and liabilities — clarifying who is responsible for existing debts, such as loans or student finance
  • Inheritances and gifts — protecting family money or property either partner expects to receive
  • Business interests and pensions — keeping a stake in a business or pension distinct from shared assets

A prenup cannot override a court's duty to provide for the reasonable needs of both parties and any children, and arrangements for children are always decided in their best interests at the time. UK Prenup is not a law firm and does not provide legal advice; both parties should consider independent legal advice before signing.

There's no fixed deadline in England & Wales, but the earlier the better. Signing well in advance helps show that neither partner felt rushed or pressured, which is one of the things a court will look at. As a general rule of thumb, couples are often advised to have the agreement finalised and signed at least 28 days before the wedding.
