What you both need to disclose for a prenup

Work through what each of you owns and owes, ticking off anything already dealt with, and get a printable list of the documents you still need and where to get them. Full and frank disclosure is one of the things a court looks at when deciding how much weight to give a prenuptial agreement.

Before you start

One date for both of you makes the two schedules comparable.

Tick each item once it is dealt with

A tick means the document is in your hands, or the category genuinely does not apply to you.

What you own and owe You Your partner
Property you own A home, a flat, land, or a share in any of them.
Mortgage or secured loan Whatever is still owed against a property, including a second charge.
Savings and current accounts Every account in your name, and your share of any joint account.
Investments, shares and crypto Stocks and shares ISAs, funds, bonds, premium bonds, shares in someone else's company.
Pensions Every scheme you have ever paid into, workplace and personal, however small.
A business or company interest A limited company, a share in a partnership, or a sole trade.
Vehicles Cars, motorbikes, a campervan, a boat, anything with a logbook.
Valuables and possessions Jewellery, art, watches, instruments, anything you would insure separately.
Income Everything you receive before tax: salary, self-employment, rent, dividends, benefits.
Debts you owe Credit cards, loans, overdrafts, car finance, buy now pay later, tax owed, money owed to family.
Inheritance and family money Anything you have already received, and anything you reasonably expect to receive.
Overseas assets Property, accounts, pensions or investments held outside the UK.

This is preparation, not a legal schedule. Full and frank disclosure means everything material, and this list is a starting point rather than a legal minimum. If you own something that isn't on it, it still belongs in your agreement. Nothing you tick here is sent to us or stored on our servers, it stays in your browser.

How to gather it, in order

Most couples can pull this together in an afternoon, apart from the one document that has to be requested weeks in advance. Work in this order and nothing holds you up.

Agree one valuation date

Pick a single day and value everything as at that date, so the two schedules compare like with like and neither of you is working from older figures.

Request the pension figures first

Ask each scheme in writing for a Cash Equivalent Transfer Value. Only the scheme can issue one, and it has up to three months to provide it, so this is the document that decides your timetable.

Download everything you already have

Statements, payslips, SA302 tax calculations and filed company accounts are usually available the same day, from your banking app, HMRC online account or Companies House.

Exchange the schedules, then keep them

Each of you gives the other the full picture, and you both keep the documents with the signed agreement, so years later there is no argument about what was known. Then start your prenup, and check how strongly it would stand up.

It is the exchange, before you sign, of a full picture of each person's finances: what you own, what you owe and what you earn. Courts in England & Wales expect full and frank disclosure, and it is one of the factors weighed when deciding how much weight to give a prenuptial agreement (Radmacher v Granatino, 2010). One document per item you are disclosing: a title register and a valuation for property, a redemption statement for a mortgage, a statement for each account, card, loan and overdraft, a CETV for each pension, filed accounts for a business, and payslips or SA302 tax calculations for income. Hiding something material undermines the whole agreement. If it surfaces later, the other person can ask the court to look again, and an agreement made on an incomplete picture carries far less weight. It is much easier to disclose a small asset now than to explain a missing one later, which is why this list errs on the side of including things.

No rule requires it, but it makes the two schedules comparable and much harder to argue with afterwards. Pick one date, ask for every figure as at that day, and write the date on the schedule. Where a document is a little older, say so on the schedule rather than leaving the gap unexplained.

Ask your pension scheme in writing for a cash equivalent transfer value. Only the scheme can produce one. You are normally entitled to one free of charge in any twelve months, and the scheme has up to three months to provide it, so request it before anything else on the list.
