Sample prenuptial agreement (England & Wales)
This is a complete sample prenuptial agreement, eleven pages long, written for a fictional couple so you can read every clause before you decide whether a prenup is for you. It follows the structure UK Prenup uses for the agreements it generates: the background and status clauses, how property and the family home are treated, inheritance, debts, maintenance, the independent-advice and timing acknowledgements, both partners' financial disclosure schedules, and the signing pages.

The sample is for Eleanor and Callum, an invented couple in Bristol marrying in May 2027. She owns the flat they live in and expects an inheritance; he has a teacher's pension and a student loan. Each takes independent legal advice from a different firm. The agreement works through the questions every couple has to answer:
- Who the parties are, when they intend to marry, and what they have disclosed
- The status of the agreement: what it asks the court to do, and what it cannot override
- Property each of you owned before the marriage, and gifts and inheritances
- The family home, including a home one partner already owns
- An inheritance one partner expects, recorded so both enter the agreement knowing of it
- Gifts and transfers between the two of you
- Debts in each name and jointly
- Spousal maintenance, and the court's duty to meet needs
- A lump sum one partner agrees to pay if they separate after five or more years of marriage
- What happens on a death, and how the marriage affects a will made before it
- Independent legal advice: which firm advised each partner, and when. An agreement can instead record an informed decision to go without advice, but that is weaker, especially for the partner with less
- Timing and the absence of pressure, with the 28-day point explained
- How the specific clauses and the general ones fit together
- Schedule A, Schedule B and Schedule C: each partner's assets and liabilities, and the joint ones
- Execution as a deed, with independent witnesses, and an optional certificate of independent legal advice
How a sample differs from your agreement
A sample shows you the shape of a prenup; it cannot be your prenup. The clauses that matter most are the ones written around your own circumstances: which assets are kept separate, what happens to a home one of you brought in, how an inheritance is treated, and what each of you has disclosed. When you create a prenup with UK Prenup, you each answer those questions online and the agreement is generated from your answers, with your disclosure schedules built from what you enter, from £199.
A court is more likely to give an agreement significant weight where it was freely entered into with a full appreciation of its implications and it is fair to hold you to it. In practice that means full disclosure from both of you, independent legal advice for each of you (especially the partner with less), and signing well before the wedding. The sample records these in its status, disclosure, advice and timing clauses. Whatever it says, a court will still meet each partner's genuine needs and any child's. Our guides explain what to include in a prenup, whether prenups are legally binding and what to watch for in a prenup template.
UK Prenup is not a law firm, is not regulated by the Solicitors Regulation Authority, and we do not give legal advice. The sample is general information to help you understand what a prenuptial agreement looks like; take independent legal advice on your own agreement before you sign it.
Sample prenuptial agreement: questions
Can I use the sample as my own prenup?
No. The sample is written around an invented couple's finances and intentions. A prenup only does its job when its terms and its disclosure schedules are yours, so use the sample to understand the clauses, then create your own agreement from your own answers.
Is this what a UK Prenup agreement looks like?
Yes. The sample was generated by UK Prenup from an invented set of answers, so the structure, the wording of the standard clauses and the schedules are the ones your own agreement would have. The specific clauses change with what you tell us. The specimen markings are the only addition: a banner on the first page, “SPECIMEN” in the page footers, and the reference “SAMPLE” where your agreement shows your order reference.
Does the sample work in Scotland or Northern Ireland?
No. It is drafted for the law of England and Wales. Scotland treats a prenup as a binding contract under its own statute and Northern Ireland has its own rules; see our guide to prenups in England & Wales versus Scotland.
